1. Introduction

Welcome to Lexiswap, a social language exchange network. These Terms of Service govern your use of the Lexiswap platform, including our website located at lexiswap.com, mobile applications, and all related services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms.

2. Using our Services

You must follow any policies made available to you within the Services, including our Community Guidelines. You may use our Services only as permitted by law. We may suspend or stop providing our Services to you if you do not comply with our terms, policies or community guidelines, or if we are investigating suspected misconduct or abuse.

3. Your Lexiswap Account

You need a Lexiswap account to use our Services. When you create your account, you must provide accurate information and are prohibited from using false personal information or creating an account for anyone other than yourself. You are responsible for maintaining the security of your account and password, and you are fully responsible for all activities that occur under your account.

If you are under 16 years of age, you must have your parent or legal guardian's permission to use Lexiswap. If you are under 13 years of age, you may not use our Services.

4. Privacy and Content Sharing

Our Privacy Policy explains how we collect, use, and share information when you use our Services. By using our Services, you agree that Lexiswap can use such data in accordance with our privacy policies.

5. Your Content

Our Services allow you to create, post, share, store, and exchange content with other users. You retain ownership of any intellectual property rights that you hold in that content. You are responsible for the content you share. Content that violates these Terms, our Community Guidelines, or the intellectual property rights of others may be removed and your account may be suspended or terminated.

6. Community Interactions and User Conduct

Lexiswap is a community-based platform. You agree to interact respectfully with other users and not to engage in harmful conduct including but not limited to:

• Harassment, bullying, or intimidation of other users
• Hate speech, discriminatory remarks, or content that promotes violence
• Sharing misleading, false, or deceptive content
• Spamming, phishing, or sending unsolicited messages
• Attempting to manipulate the platform or boost engagement artificially
• Sharing sexually explicit or pornographic material
• Impersonating others or creating fake accounts

7. Content Moderation

We strive to create a safe and positive environment for language learning and cultural exchange. We may review, screen, and remove content that violates our Terms or Community Guidelines. However, we cannot review all content before it is posted, and your use of the Services is at your own risk.

8. Intellectual Property Rights

The Lexiswap platform, including its design, logos, features, and functionality, is owned by Lexiswap and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, create derivative works, reverse engineer, or extract source code from our Services without our explicit permission.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LEXISWAP, ITS LICENSORS, AND ITS THIRD-PARTY SERVICE PROVIDERS DO NOT WARRANT THAT THE SERVICES ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE. LEXISWAP DOES NOT CONTROL, ENDORSE, OR TAKE RESPONSIBILITY FOR ANY CONTENT AVAILABLE ON OR LINKED TO THE SERVICES OR THE ACTIONS OF ANY THIRD PARTY OR USER, INCLUDING MODERATORS. WHILE LEXISWAP ATTEMPTS TO MAKE YOUR ACCESS TO AND USE OF OUR SERVICES SAFE, WE DO NOT REPRESENT OR WARRANT THAT OUR SERVICES OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

IN NO EVENT AND UNDER NO THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE, WILL THE LEXISWAP ENTITIES BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES, INCLUDING THOSE ARISING FROM OR RELATING TO CONTENT MADE AVAILABLE ON THE SERVICES THAT IS ALLEGED TO BE DEFAMATORY, OFFENSIVE, OR ILLEGAL. ACCESS TO, AND USE OF, THE SERVICES IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA RESULTING THEREFROM. IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE LEXISWAP ENTITIES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR ANY AMOUNT YOU PAID LEXISWAP IN THE PREVIOUS SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Lexiswap, its parents, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents, and advisors from any and all claims, liabilities, costs, and expenses, including, but not limited to, attorneys' fees and expenses, arising out of a breach by you or any user of your account of these Terms or arising out of a breach of your obligations, representation and warranties under these Terms.

12. Disputes Between Users

You are solely responsible for your interactions with other users. Lexiswap reserves the right, but has no obligation, to monitor disputes between you and other users. Lexiswap shall have no liability for your interactions with other users, or for any user's action or inaction.

13. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by Lexiswap. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

14. Changes to Terms

We may modify these Terms at any time. We will post the changes on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
